Someone died childless and bequeathed his estate - after paying the ketubah to his wife - to the Jewish community so that it would distribute the tithes annually. After the community administration had already taken possession of the estate - after three months - the wife realized that she was pregnant. Solomon Jessurun decides that the child must receive the estate. If the estate itself, even if only in part - after payment of the ketubah - had fallen to the community, the child would have received only the remainder, but if this were not sufficient for his livelihood, he would have had a claim against the community for the tithes.
