Hirsch Summary
A and B received a shipment of cocoa from overseas, which they initially did not want to sell due to the low price (8 Prutoth per liter). Instead, they stored it. B, out of necessity, took some from the stock when bills of exchange (lettras de cambio) were presented against him. Later, the cocoa was discovered to be missing. At the time of discovery, it was priced at 15 Prutoth, and at the time of filing the complaint, it had risen to 24 Prutoth. What price must B compensate A? Abraham ben Jacob de Salomo de Meza rules that B should pay the market price at the time of discovery, which was 15 Prutoth. Refer to section 172.
