Hirsch Summary
Someone left his estate to his two sons, giving the firstborn two shares and the second one share. To his widow, the stepmother of his sons, he bequeathed a lifelong usufruct of 12,000 florins, to be divided in a 2:1 ratio after her death. The widow entrusted the money to the elder son for management. The younger son fell into distress and reluctantly sold his share of the 12,000 florins to his brother for 1,600 florins. Beforehand, he had secretly drafted a document and had it signed by two witnesses. When the stepmother passed away, he presented the document to his brother and demanded this amount as his inheritance. Isaac Sarucco ruled against B.
