A and B jointly wanted to send goods to C overseas. They rented 10 units of cargo space on a ship for both the outbound and return journeys because C was supposed to deliver goods to them. However, for the return journey, C could only provide 5 units of goods that concerned both A and B, and 5 units of goods that concerned only B. A disagreement arose between A and B regarding the payment for the return freight of these last 5 units. Chija Cohen de Lara thoroughly examined how freight transactions are typically conducted and ruled that A and B, unless otherwise specified in the agreements, should each pay half of the disputed 5 units.
