A man stipulated on his deathbed before two witnesses and his two sons that his estate should remain under the administration of the Beth Din until the death of his wife. During this time, the sons were only to have the enjoyment, and the younger son, B, was to be obliged to live with the mother and pay her a specified amount for it. If he did not do so, the older son, A, would also receive B's share, that is, everything. B's wife refused to move in with her mother-in-law, and B relented. Nevertheless, he wanted his share of the enjoyment because, as he argued, the conditions set by the father were legally invalid and void. David ben Abraham Franco Mendez rules in favor of B.
