When A wanted to collect a debt of 1,000 fl. from B, C declared that he would assume the guarantee for B. However, B fled after the agreement, and A demanded that C pay based on the guarantee. C argued that the guarantee was not properly formalized. A then explained that he had refrained from sending B to debtor's prison specifically because of the guarantee. David ben Raphael Meldola decided that C was not liable.
