Hirsch Summary
A, a Jew, had borrowed 1,000 florins from a non-Jew, which the Jew intended to repay only after the death of his brother, whose heir he was. Both the Jew's brother and the non-Jew went on a sea voyage. Upon the non-Jew's return, he reported that the Jew had died. The question now arises: Can the Jew's brother perform the levirate marriage (yibbum), or is the non-Jew's statement, due to his financial interest, considered unreliable? Jacob ben David Fidanque considers the statement credible but requires confirmation from the rector.
