Hirsch Summary
A borrowed money from B, pledging his real estate and movable property. Later, he sold a part of his real estate to C and further borrowed money from a non-Jew. A fled to evade his creditors, and B demanded the borrowed money back from C based on his legal titles. C referred B to A's residential property, which was unencumbered. With regard to the non-Jewish creditors, B did not want to take possession of the house. David ben Raphael Meldola decides that B should first be paid from the proceeds of the residential property. If these proceeds are insufficient, then C must pay.
