Hirsch Summary
Someone wanted to build a house in his garden. The neighbor objected before the construction began. It is inquired whether this objection should be granted and whether it makes a difference if the objection is raised before the start of the construction or after its completion - if built without the neighbor's consent. Jacob ben David Fidanque decides that the builder should construct at a certain distance from the neighbor's house. This distance is greater if one follows Maimonides than if one follows Rabbi Asher. However, if the house is already built, even a minimal distance won't matter if there was no objection. All of this applies within the customary law of the respective country.
