Hirsch Summary
A wanted to travel by ship to a distant land and took valuables for B with him. Fearing pirates, who had recently made the sea unsafe, A abandoned the ship en route and chose the potentially riskier overland route. Here he was robbed, and B's belongings were also lost. B wanted to hold A responsible for the loss due to the change of route. Moses ben Samuel Israel decides that A is not liable unless it was almost certain beforehand that A would fall into the hands of robbers. Cf. 853.
