Parents had vowed during their daughter's illness to marry her only to a Torah scholar. When the husband once embarked on a sea voyage, he gave his wife a general power of attorney. Based on this power of attorney, she arranged a marriage contract (Kiddushin) for the daughter in Nisan. The husband was unaware of this during his journey and arranged Kiddushin with another man in Tishri. When the father returned home, he regretted his hasty act but maintained that the wife's power of attorney had always been valid. David ben Raphael Meldola rules that the wife's power of attorney does not authorize the acceptance of Kiddushin; this should have been expressly stated. Therefore, the second marriage arrangement is valid, but the first one is null and void. See also No. 54.
