A claimed that the house he occupied was properly gifted to him by his deceased wife's two brothers, with the condition that it would revert to her family only if she died childless. However, no document existed because the brother-in-law B (the other was deceased) refused to sign it. He provided witnesses. B demanded that A vacate the house. Jacob de Tobar decides to leave A in possession of the house.
