Trader A, who lived in Constantinople, sent B to Venice to collect items belonging to him. B also took items from himself and from C at the same time. On the way, he was detained by enemies of A. They allowed him to keep his own belongings, but the leader took A's belongings, while a servant took C's belongings. Through a circumstance not described in the query, A managed to recover some of his belongings, while C received nothing back. C wanted to hold B responsible for the damage, arguing that B had saved his property at C's expense. Abraham ben David Fidanque decides that B is not liable to compensate C for the damage, referring to his earlier decision in a similar case: No. 588.
