A made an offer to B for his house and furniture amounting to 10,000 florins; B declined. A told C about it and remarked that he was now glad about the rejection as he had made the offer thoughtlessly. C then approached B, referring to the conversation with A, and offered 10,000 florins for the house himself. Now B accepted the offer, but when writing down the contracts, a dispute arose whether the house should be sold with or without furniture. Abraham Fernandez decided, mainly based on commercial custom, that the empty house was sold.
