Hirsch Summary
A had insured his goods loaded on a ship with B through an insurance broker (seguros). The crew mutinied en route, seized the ship, killed the captain, and sold the cargo. A then demanded payment from B, who refused as it was not covered by the policy. Isaac ben Jacob Henriquez Faro brought forward the wording of the policy (polissa de seguro), which stated: "In addition to all the mentioned mishaps, we also assume liability for damage caused by ocean waves, fire, wind, scorching winds, storms, and so forth, for criminal and negligent acts of the captain and crew, as well as for any kind of ruin and damage that may befall this property or these goods, regardless of whether now known or unknown in their nature, frequent or rare; no case is excluded." He concluded that B was liable to pay. At the end of the response, Faro mourned the passing of Rector Abendana de Britto.
