A guardian rented out a house on behalf of his ward three times for periods of three years each, at an annual rent of 350 florins. When the young man came of age, the guardian handed over all the documents except for the rental agreement. The young man wanted to re-rent the house and found a tenant willing to pay 500 florins. Upon reviewing the house records, he discovered that his father had always rented the house for this higher price. The young man then sought to hold the guardian liable for the difference in rent, if not for all nine years, then at least for the year since he had come of age, arguing that the guardian no longer had the right to manage the property during that time. Additionally, he demanded that the guardian take an oath, contrary to the terms of his appointment. Moses ben Samuel Israel ruled in favor of the guardian regarding the financial claim but decided that the guardian must take the oath.
