A woman, after her husband died childless, fell to a brother-in-law. He betrothed the woman within 3 months after his brother's death but did not consummate the marriage. Considering that a woman may only remarry 3 months after her husband's death, the question arises whether the second husband should be excommunicated for violating this ordinance. Moses ben Samuel Israel denies it.
