PEH069
Hirsch Summary
A woman brought gemstones worth 3000 fl. as a dowry to her husband. The stones were stolen during a break-in but were partially returned by the thieves later. When the childless woman died, her relatives claimed half of the dowry from her husband according to the Kethuba. He refused to pay, arguing that the dowry was stolen, and the returned stones were his property. According to Talmudic law, someone who has given up hope of recovering lost or stolen items loses their ownership rights. Dr. Aron Ledesma supports the relatives' claim.
