Hirsch Summary
Dedication page of Abraham Raphael ben Chajim Albergue. Inquiry by Jacob ben David Fidanque: A man, on his deathbed, bequeathed 20,000 guilders to his wife and each of his four sons; another 20,000 guilders were set aside because the wife was pregnant. A son to be born to her was to inherit this sum in full, a daughter only 10,000 guilders, and then the brothers were to share the rest. However, after the man's death, the wife gave birth to twins, a son and a daughter. Abraham Raphael ben Chajim Albergue decides that the remaining 20,000 guilders should be divided equally among the six children because it is doubtful whether the twins would have received anything at all. The father had only spoken of the birth of a son or a daughter. Cf. 19 (should be 18) and 360.
