Hirsch Summary
A deceased wife came from a marriage where both parents had been previously married. Each had a son from these previous marriages, making them stepbrothers of the deceased wife from both the paternal and maternal sides. A dispute arose between these stepbrothers of the deceased wife over the half-dowry refunded by the husband. The stepbrother from the maternal side and the mother had undoubtedly paid the dowry because the father had been notoriously penniless. However, to preserve his honor, it was written in the ketubah: "the dowry, which comes from the house of the father and the mother." Nevertheless, Jakob de Tovar decides that the stepbrothers from the maternal side and from the paternal side inherit equally.
