A merchant A overseas sold goods there on commission for Amsterdam merchants. He also assumed the credit risk for an additional 2%. One delivery was contested; the buyer claimed the goods had been lying in the sea for a long time on a sunken ship. A was ordered by the court overseas to take back the goods. He then wanted to seek recourse from his supplier in Amsterdam, to whom he had already transferred the money. Chija Cohen de Lara instructed the merchant overseas to provide evidence for his claim or to swear an oath; if he succeeded in the former or swore, he would be entitled to get the money back.
