Someone (A) assumed that his only son, who had been abroad for twenty years without any communication, was deceased. When A passed away, he stipulated: 'Since I have unfortunately heard that my only son has died, my house manager (casiero) shall inherit from me, as it is through him that I have become wealthy. However, if my son were to return at any time, the house manager should give him 100,000. The rest shall remain with the house manager. After 2 years, the son returned. He wanted to claim the entire inheritance, arguing that the will in its initial part supported his claim. Jacob ben Abraham Baffan agrees with the son.
