A, separated 200 pounds from a shipment received from overseas, intending to sell it to his brother B at the corresponding price used for the rest of the goods. A personally weighed the portion for B in the presence of two workers. Due to weight loss caused by moisture, B discovered a 3% discrepancy after 14 days when he re-weighed the goods. B wanted to adjust the payment accordingly. A argued that the other buyer had also paid for the moisture, so it was factored into the price. Isaac Sarucco ruled that if the sale was considered final and customary trade practices accounted for the weight loss, B should pay the full amount. See reference 637.
