Hirsch Summary
Someone lent his niece 100 fl. on a promissory note for one year. Since the girl did not repay promptly, the uncle betrothed the girl to himself before two witnesses, saying that he betrothed her to himself with the benefit arising from the extension of the loan by one year. Is the marriage valid? Samuel Mendes de Sola considers it doubtful; therefore, the girl may not stay with him without a new Kiddushin, and she may not marry another man without a divorce. See No. 170, 929, and 944.
