Hirsch Summary
In the case of a man who lived next to the synagogue, the Torah ornaments were kept with him; he or the sexton would bring the items to and from the synagogue on Mondays, Thursdays, and Sabbaths. His home was broken into, and the silver items were stolen. The community leaders held him responsible, arguing that the items had not been stored in a lockable chest. The man countered that he did not own such a chest and that the leaders and the sexton were aware of this. Joseph ben Moses Alvarez ruled that the man was not required to compensate for the loss.
