Hirsch Summary
Inquiry from Jacob Ferrares: A submits to the Beth Din a promissory note against B for 1000 sus. B acknowledges that the promissory note is from him but claims that only 900 is the actual debt, while 100 is interest. Therefore, the entire note is invalid. A agreed to the deduction of 100 sus but demanded the remaining 900. Joseph ben Moses Alvarez decides that the debt of 900 sus should be regarded as an undisputed debt, just like one without a promissory note. This decision, as stated in the conclusion, should have appeared on Rosh Chodesh Shebat but only appears on the 17th Iyar 5561. The question is literally the same as the one in ??? ???? (II No. 33). See No. 941.
