Hirsch Summary
A man died, and three days later his wife, who had been seriously ill for some time, followed him in death without having sworn to the Kethuba. A creditor wanted to satisfy his claim in advance. The children argued that 1. besides the house, nothing else was available, 2. their father had already sworn to the creditor and promised him everything he earned, 3. the mother had been prevented by her illness from taking her Kethuba, 4. they, the adult children, had already waived their mother's oath. Jacob Tovar decides in favor of the children.
