A guardian demanded payment of an old promissory note, which the debtor claimed to have already paid. The debtor was willing to swear an oath only if the guardian deposited the note with the court. The guardian refused to deposit it. Abraham ben David Fidanque rules in favor of the guardian. He may retain the note even after the oath is taken. Cf. 624, 831, 905.
