Hirsch Summary
A non-Jew owed A 10,000 guilders. Since A urgently needed the money, the non-Jew, who did not have the capital himself, borrowed the money from B with interest and gave it to A, who undertook the suretyship for both the principal and the interest to B. The non-Jew paid the interest through A's intervention for several years, then stopped paying altogether. Now B wanted the money from A. A not only refused to pay the last interests but also wanted to repay the principal only with a deduction of all interest already paid. Because, as he said, the entire transaction violated the prohibition of usury. Moses ben David Rodrigues Lopes decides that A must pay the principal in full but not the last interests. However, if he wanted to pay them, he would by no means violate the prohibition of usury.
