Hirsch Summary
A demanded payment of a debt of 1000 guilders from B. B claimed that he had already paid him long ago. A had not had time to look for the promissory note at the time of payment, so the refund was omitted. Nevertheless, he would pay if A swore in court that he had not received anything yet. A died before taking the oath. His heirs insisted on the demand. Moses ben Samuel Israel imposes the oath on the heirs that they did not find the promissory note among their father's papers. If they swear to this, they should receive the disputed amount. Cf. 48.
