Hirsch Summary
Between the owner of the ground floor and the owner of the first floor, a dispute arose regarding who should bear the cost of replacing a defective beam. Abraham ben David Fidanque decides that in principle, the owner of the ground floor is obligated to cover this cost; however, since in the present case only one beam is defective, which according to the opinion of experts forms part of the ceiling structure together with several others, the owner of the ground floor cannot be forced at this time to undertake the replacement.
