Hirsch Summary
A had two promissory notes and B had one against the same debtor, who was almost insolvent. Do they share, to the extent anything can be obtained, according to the number of promissory notes, meaning A gets two-thirds and B gets one-third, or do they split whatever is obtained in half? Abraham ben David Fidanque decides: If the three promissory notes bear the same date (or even the same hour, if such is stated in the promissory note), A gets two-thirds, B gets one-third. Otherwise, the earlier promissory note takes precedence. However, if the debtor acquired assets after the issuance of the last promissory note, A and B must split equally. Cf. Nr. 351.
