Hirsch Summary
A received a commodity from overseas, where it is known that slow weight loss occurs due to drying. When he sold the commodity, he kept 400 pounds for his friend B and weighed it in front of two workers. He offered it to B at the same price as he sold the other commodity. When B wanted to accept the commodity, he found a 4% underweight and wanted to reduce the purchase price accordingly. Joseph Piza declares the deduction to be unjustified since B only has to pay the price paid by the other buyer. For this commodity, a 4% loss per month is nothing unusual. The decision applies under the condition that there is no contrary commercial custom. Cf. 234.
