Hirsch Summary
A woman gave birth to a daughter 8 months and 19 days after her husband's death, who died 28 days after her birth. Of her husband's three brothers, the first was married to her sister-in-law, the second had sworn neither to marry her nor to perform Halitzah with her. The questions arose: 1. whether the woman needed Halitzah at all, 2. whether the oath was legally effective, so that the duty of marriage or Halitzah lay with the third brother. Moses ben Samuel Izrael affirms both questions.
