Hirsch Summary
A borrowed 2000 guilders in cash from his friend B and pledged silverware worth 3000 guilders as security. When B had to travel overseas, he wanted to sell the pledge and pay A the surplus. At A's request, he refrained from doing so and left the pledge with C, who lived nearby. C suddenly died, and when B returned, he could not find A's silverware, nor was there any record of its whereabouts. A claimed that B had received the proceeds from it along with other goods that C had shipped to him, and that C had simply failed to mention it in the accompanying letter. Moreover, the pledge with C was under B's risk. B did not acknowledge this and pointed out that C owed him a lot of money. Moses ben David Rodriguez Lopez decided that A did not have to repay the 2000 guilders, but B also did not have to compensate A for the added value.
