Hirsch Summary
Dedication of David ben Raphael Meldola on the occasion of the first response he issued. An inquiry from Joseph Montel to David Mendoza: A sold 6000 pounds of pepper to B, 3000 white and 3000 black, at a unit price, and received immediate payment from B. Delivery was to be made on the first ship sailing to Salonika. A delivered only the black pepper (the less valuable one). He refused to deliver the white pepper, as he did not possess any white pepper at the time of concluding the contract, and this circumstance is equivalent to someone selling a non-existent item. B refused to accept the black pepper at the contract price, as this price only applied to both types combined. David ben Raphael Meldola agrees with B. [The dating 5516 is an error, as Rabbi Salem, mentioned in the dedication, did not arrive in Amsterdam until 5522.]
