Hirsch Summary
A and B had a joint business venture. After dissolving the partnership and settling accounts, A managed to recover fees that he had wrongly paid to another Jew. B claimed half of these recovered fees. Samuel ben Salomo a'Cathan sided with B, further explaining that a partner who undertakes actions without the knowledge of their co-partners is always at a disadvantage. Although they must share profits, they cannot hold their co-partners liable for losses.
