Hirsch Summary
A, B, and C jointly inherited an estate. A and B, who resided in the deceased's residence, urged to sell the estate's assets. D, a friend of C, strongly warned against starting the sale until his authorization and instructions from C arrived. Despite this, A and B sold the inventory from the estate to E. The rest was sold after C's instructions arrived, with D's involvement, mainly through an auction. E became insolvent before paying for the goods he had taken over. C held A and B liable for the damage. He also pointed out that A and B had pursued another claim against E more vigorously and had only allowed a longer term for the inventory out of self-interest. Abraham Fernandez recognizes C's claim as justified.
