An older man who married a young woman wrote in the marriage contract that he would give her 20,000 guilders. In case the man survived his childless wife, nothing was mentioned. When the wife died after 2 years without leaving any children, a dispute arose between the wife's relatives, who attributed the absence of provision to an oversight and therefore relied on the customary rules of division, and the widower, who claimed the rights given to him by the Torah, meaning he claimed the entire inheritance. David ben Raphael Meldola is of the opinion that the widower should be supported unless there is a contrary custom in the place, such as in Constantinople, where nothing is written about it in the marriage contract, but the Toledano custom of sharing is followed.
