Title
PEH439
Hirsch Summary
A sent a series of goods to two merchants, B and C, with instructions to sell the cargo only for cash and to return the ship, loaded with local produce, as soon as possible. While B promptly handed over the return freight to the captain, C allegedly sold a portion on a six-week credit, did not sell another portion at all, and the buyer of C became insolvent. Consequently, the ship returned with only half the cargo. A held C responsible for the damage. Chija Cohen de Lara orders C to reimburse the damage, as C apparently failed to prove that he was not at fault for the impossibility of selling.
