Hirsch Summary
A, who needed 10,000 guilders, wanted to borrow the amount from his friend B for 3 months. B could not provide the amount as he had just bought gems worth 18,000 guilders. He asked A to try to sell the stones for 20,000 guilders. If he succeeded, he would receive the loan. A sold the stones for 25,000 guilders. In addition, the buyers (probably due to a misunderstanding) paid an additional 3,000 guilders. A now wanted to give B only 20,000 guilders, but now waive the loan and the broker's fee. However, B demanded the entire amount. According to the judgment of Moses ben David Rodrigues Lopes, B receives the additional benefit of 5,000 guilders, while A receives the profit resulting from the misunderstanding. The decision says nothing about the loan.
