Hirsch Summary
Someone, in old age, had given a business power of attorney to an employee. The employee embezzled a large sum and fled. When the creditor wanted to collect a debt of 2000 guilders, the debtor produced a receipt for a partial payment of 1000 guilders and claimed to have paid an additional 500 guilders, which he attempted to prove by presenting his books. The debtor did not have a receipt for the entire amount, as he explained that the employee had not had time to give him one; he had promised to give it to him another time. Moses ben Samuel Izrael decided that the debtor had to swear an oath regarding the repayment of the 1500 guilders. If he swore it, he would only have to pay the remainder, which was 500 guilders.
