Someone was ill and believed he was dying. Since his marriage was childless, he wanted to exempt his wife from levirate marriage and Halitzah, so he gave her a bill of divorce. The bill of divorce was supposed to take effect immediately upon delivery if he died during his illness. The delivery took place. Then the sick person somewhat recovered but died after 8 days when a new illness occurred. Abraham Fernandez still considered the divorce valid, especially since the man had been so weak that he had not left his house.
