Hirsch Summary
A was taken to a non-Jewish court by his creditors and was sentenced there. His entire estate was distributed among the creditors. B had received a number of valuables from A for safekeeping, which A had given him to protect them from being seized by the creditors. B, not wanting to expose himself to any legal actions, brought the items to C. There, they were destroyed in a fire. A demanded compensation from B. Samuel ben Solomon of Catan ruled that B would be liable unless B or other witnesses had seen the valuables burn, or unless A had also frequently entrusted items to C for safekeeping. See also 938.
