Hirsch Summary
Someone bequeathed in their will 1000 fl. "for the construction of a synagogue." Before the executors could pay out the amount, the Jewish community left the place, and the old synagogue was destroyed. The majority of Jews settled in a nearby location. They took their "holy articles" (miqtzé kodesh) with them, and the executors gave them 200 fl. from the bequest for the construction of their synagogue in their new home. Later, Jews resettled in the old location. They wanted to rebuild the house of worship at the old site and demanded the entire bequest from the executors, including the 200 fl. But now, the Jews from the second location also claimed the remainder of the bequest. Finally, the heirs demanded that the executors pay out the entire bequest. Abraham Fernandez awards the bequest to the newly emerging community at the old location.
