A and B jointly owned a piece of land. This land was leased to a potter who did not utilize the entire space. A built a house on his own expense in one corner of the property. The tenant agreed to this arrangement and continued paying the same rent, so B did not suffer any loss during the division of the rent. However, B still wanted half of the rental income beyond the regular rent because the house was built on the jointly owned land. Moses Alvarez grants B an amount equivalent to half of the theoretical rental value that the ground beneath the newly constructed house possesses and rejects any additional claim.
