Hirsch Summary
A saw a piece of carmine-red fabric at B's place and asked him, A, if he could sell it to a wealthy man, C, who was looking for such fabric for a coat. They agreed on the price and went to C. Since they didn't find him at home, A, with B's consent, left the piece of fabric at C's house. When C returned home, he found a flaw in the piece and didn't want to keep it. A wanted to return it to B. However, B said he had sold it to A; the flaw could only have occurred at C's house. Samuel Mendez de Sola decides that B should swear that the piece was flawless when he had it. If he swears, A has to pay for the fabric. C is not involved in the matter; he is not even considered a gratuitous custodian. After Response 48 with Custody 52, Response 49 again has Cust. 51, but Response 50 has Cust. 52.
