A bought a batch of clothes from B for delivery in six months and paid the price of 1100 florins immediately. He fell into financial difficulty during the period until delivery and therefore assigned the rights from the purchase agreement to C for immediate payment of 1000 florins. It was agreed that if A did not deliver on time, he would have to refund 1100 florins to C. When the delivery date came, the clothes were much higher in price. A refused to deliver the clothes supplied by B to C, claiming that C had violated the Torah's prohibition on interest. He made three proposals to him: 1.) A would repay the 1000 florins, and C would waive delivery. 2.) C would pay an additional 100 florins and receive the goods. 3.) C would take over part of the goods for 1000 florins at market price. C rejected the three proposals and insisted on delivery. Salomo Jessurun decides that A must fulfill the original agreement.
