Hirsch Summary
A firstborn, A, and his brother, B, inherited a considerable fortune from their father, who had not made a will, and continued to operate the paternal business without a partnership agreement. A was in charge of accounting, while B conducted the actual business. The profit was never distributed or allocated to the capital accounts. After B's death, his sons wanted to withdraw their money from the company, and from their grandfather's inheritance, they claimed only one-third, as the firstborn receives two parts, and they demanded half of the profit. Samuel Mendes de Sola decides accordingly.
