Hirsch Summary
Two Amsterdam merchants, A and B, were owed money by an out-of-town merchant who, despite repeated reminders, did not pay. A suggested that he should try to collect the money for their common account using all means available. B declined. Nevertheless, A proceeded and deducted the travel expenses from the partnership fund. He managed to collect half the debt and now wanted to keep this amount for himself, only refunding the expenses, while B claimed half of the collected amount for himself, pointing out that the partnership fund had already paid the expenses. David ben Raphael Meldola rules in favor of B.
